3. This agreement may be cancelled by either party if it conflicts with any current contract for the supply of energy to the same property, except where the prior contract is set to expire before the new marketing contract commences.

4. This agreement may be cancelled without penalty within one year from the date the agreement is entered into if Leap Energy:

a. does not set out a specified or ascertainable date on which the supply of energy is to begin,

b. does not begin supply of energy within 30 days of the date referred to in clause 3(b) or an amended date agreed upon in writing by you, the customer and Leap Energy, or

c. was not licensed at the time the marketing contract was entered into.

5. This agreement is not valid unless the disclosure statement on page 4 has been correctly completed by Leap Energy Solutions Corp. and you, the customer ,before you enter into the marketing contract.
